These Terms govern access to and use of the website at https://witarist.com (the "Site") and the staff-augmentation services provided by Witarist IT Services Private Limited ("Witarist", "we"). By using the Site you accept these Terms. If you don't agree, please don't use the Site.

1. What we do

Witarist is a staff-augmentation platform. We maintain a curated network of pre-vetted developers and connect them with hiring managers and companies for full-time, dedicated, project-based engagement. We are not a job board or a freelance marketplace — individual developers are not posting jobs and not bidding on tasks. Witarist contracts directly with the client; the developer works as an extension of the client's team during the engagement.

2. Eligibility

You must be at least 18 and authorised to enter contracts on behalf of your employer (if applicable). You are responsible for keeping your account credentials secure and for all activity that occurs under them.

3. Engagements and pricing

Profile pages display indicative monthly pricing. Final pricing, engagement duration, replacement guarantee, payment terms and other commercial details are negotiated and documented in a separate Master Services Agreement (MSA) or Statement of Work (SOW) signed before any work begins. The Site itself does not create a binding commercial commitment to engage a developer.

The Site, the platform code, the curated catalogue, and the "Witarist" brand are owned by Witarist IT Services Private Limited. Profile content (developer bios, project descriptions) is owned by the respective developer and licensed to Witarist for display. You receive a limited, revocable, non-transferable licence to view the Site for the purpose of evaluating an engagement. No other rights are granted.

Work produced during a paid engagement is governed by the MSA / SOW signed for that engagement, not by these Terms.

6. Confidentiality

We sign mutual NDAs as part of every paid engagement. Information submitted through Site forms (requirements, role descriptions, company details) is treated as confidential and used only to respond to the enquiry and provide the service.

7. Replacement guarantee

If a developer placed through Witarist isn't meeting your expectations during the first weeks of engagement, you may request a replacement. Specifics (notice period, pro-rata billing, replacement timeline) are documented in the MSA.

8. Disclaimers and limitation of liability

The Site is provided "as is". We make no warranties about accuracy of profile information at any moment in time, fit with your specific role, or developer availability. Pricing shown on profile pages is indicative and may change.

To the fullest extent permitted by law, Witarist's aggregate liability arising out of or related to your use of the Site (excluding obligations under a separately-signed MSA) is limited to ₹10,000. We are not liable for indirect, incidental, or consequential damages.

9. Termination

We may suspend or terminate access to the Site if you violate these Terms or use the Site in a way that risks harm to the platform or other users. You can stop using the Site at any time.

10. Governing law and jurisdiction

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts in New Delhi, India.

11. Changes to these Terms

We update these Terms occasionally. Material changes are announced in-product or by email. The "Last updated" date at the top reflects the most recent revision. Continued use after changes constitutes acceptance.
